Suggesting that a heckler would be unable to earn a living in a Nevada brothel is political commentary--not slander--a Superior Court jury in Sacramento decided in rejecting a $2-million lawsuit against tax activist Howard Jarvis. Testimony during trial of the action for “humiliation and emotional distress” brought by Darla Davisson, 48, of Davis, indicated that Jarvis, 81, made such a remark--and that she called him a “crook”--during an exchange with hecklers at Sacramento State University in May of 1980. Jarvis acknowledged the remark, but said it was directed at another heckler and insisted he had no memory of seeing Davisson during his appearance on the Sacramento campus.
