In response to American Store’s May 3 letter, lawyers for Dublin, Calif.-based Lucky Stores Inc. denied American’s suggestions that its bid has not been fairly considered by Lucky’s directors and said their proposal for a confidentiality agreement still stands, according to a filing with the Securities and Exchange Commission. In a letter to American’s attorneys dated May 4, Lucky said it repeatedly invited American to submit an acquisition proposal by the April 25 deadline imposed on all other bidders. Lucky also said it has offered to sign a confidentiality agreement with the Salt Lake City-based store operator on terms that Lucky claims were more favorable than those offered to any other party.
