Stay of Execution Lifted Despite Medical Claim

A federal appeals court lifted a stay of execution for an Ohio prisoner who claimed an abnormality in his brain may have affected his behavior when he raped and killed a woman in 1987.
The U.S. 6th Circuit Court of Appeals in Cincinnati said the lethal injection of William H. Smith should proceed Tuesday.
Smith’s lawyer, Jennifer Kinsley, said an appeal would be filed today with the U.S. Supreme Court.
The appeals court overturned a ruling last week by a federal judge who said Smith’s execution should be postponed to investigate his medical claim.
