A federal judge who issued a groundbreaking order allowing military detainees in Afghanistan to challenge their confinement in U.S. civilian courts said it doesn’t apply to Afghans.
U.S. District Judge John Bates’ latest ruling means the United States can detain Haji Wazir indefinitely at Bagram Air Base in Afghanistan. Court documents say he has been in U.S. custody since 2002, when he was captured in the United Arab Emirates.
Bates said Wazir differed from the original case because releasing him to the host country, where he’s a citizen, could cause “friction.”
