Icahn dropped his motion for a restraining order.
The temporary restraining order was to block the Delaware Inspector of Elections from certifying the votes cast by Uniroyal shareholders on certain anti-takeover proposals. Attorneys for Carl C. Icahn said in a hearing in New Jersey Superior Court that they wanted the vote count continued and the results certified. However, Icahn will continue his challenge of the vote count, alleging that 491,000 votes that the inspector concluded were invalid should have been considered in his favor.
