A parent’s homosexuality can be considered in determining child custody after divorce, a Philadelphia Superior Court ruled in upholding a lower court decision that denied the request of a woman involved in a homosexual relationship for expanded shared custody of her two children. The court noted that the woman was involved in a lesbian relationship in Boston while the children were living with their father, Paul, and stepmother in Pennsylvania. The panel rejected her contention that a parent’s homosexuality is not an issue unless it can be shown it would adversely affect the children, pointing out that homosexuality is still against the law in many states.
