The Nation : Drug Damages Awarded
A federal court jury awarded $95 million in damages to an 8-year-old boy after finding his deformed arms were caused by the anti-nausea pregnancy drug Bendectin. The U.S. District Court jury in Washington ordered Merrell Dow Pharmaceutical Inc. of Cincinnati to pay Sekou Ealy of Washington $20 million in compensatory and $75 million in punitive damages. The jury found Merrell Dow liable for negligence in marketing and testing the prescription drug as well as for its failure to warn doctors and patients about birth defect dangers.
