An Oklahoma horseman filed a $4.6 million federal lawsuit Wednesday claiming fraud in the 1987 All American Futurity because the winning horse in the $2-million New Mexico race was drugged.
The New Mexico Racing Commission ruled in January 1988 that Elans Special, the first filly to win the race in 10 years, was drugged twice before the All American Futurity, considered the Kentucky Derby of quarter horse racing.
Doyle Rice, owner of second-place finisher Elaina Rae, asks in the suit filed in U.S. District Court in Tulsa, Okla. that Elans Special be disqualified as the winner and his horse receive the title.
