‘Malcolm’ Update: Videotape showing the beating of Rodney G. King may yet end up in Spike Lee’s new movie, “Malcolm X.” Though the filmmaker said earlier this week that he would delete the footage because of delays caused by legal maneuvering instigated by George Holliday, who shot the controversial footage, Lee’s attorneys disclosed Tuesday that they may ask the Supreme Court to review the matter as a First Amendment issue. Lee had tried unsuccessfully to get the U.S. 9th Circuit Court of Appeals to rule on an injunction in time for him to finish the movie by Oct. 8. The film is scheduled to open Nov. 20. If the Supreme Court does not take up the matter, Lee has promised Warner Bros., the studio that bankrolled the $35-million movie, that he will excise the footage.
