Investigators have toxicology report for Jose Fernandez, pitcher who died in boat crash, but won’t release it

Investigators probing the death of Miami Marlins pitcher Jose Fernandez and two friends likely now know whether the three men were drinking the morning that Fernandez’s boat slammed into a jetty off South Beach, the Miami Herald reported. They just aren’t saying.

In response to the newspaper’s request for results of any toxicology tests performed on the victims following the crash, a Florida Fish and Wildlife Conservation Commission spokesman said Tuesday that the agency has “received the report” from the Miami-Dade medical examiner’s office. The Herald requested the test results because they should show whether any among the trio drank alcohol or used any of a number of common drugs the night of the fatal crash.

But FWC spokesman Rob Klepper declined to release or discuss the tests, citing the agency’s active investigation. The Miami-Dade State Attorney’s Office, however, says it isn’t involved in any criminal investigation given that everyone involved in the crash was killed.

Fernandez, Emilio Macias and Eduardo Rivero were killed early on the morning of Sept. 25 when Fernandez’s boat crashed at around 3:15 a.m. The three men were seen early that morning at American Social Bar & Kitchen. They set out on the boat some time before 3 a.m. It’s not known if any of the three men were drinking.

Cubs’ plans

Jon Lester, who went 19-5 this season and was second in the majors with a 2.44 earned-run average, will start the Chicago Cubs’ playoff opener against San Francisco or the New York Mets, Manager Joe Maddon said. Kyle Hendricks, the ERA champion at 2.13, will pitch Game 2, followed by 2015 NL Cy Young Award winner Jake Arrieta and John Lackey.

Baseball Commissioner Rob Manfred said he remained optimistic that a new collective bargaining agreement will be reached before the free-agent signing period begins following this year’s World Series. The current CBA, in place since November 2011, expires on Dec. 2. . . . The Milwaukee Brewers said Manager Craig Counsell and his entire coaching staff will return next season.
